Equal Employment Opportunity Commission v Baltimore County

Commission brought suit alleging County’s policy of requiring higher contributions by employees hired at older ages violated the Age Discrimination in Employment Act. After a remand, the district court granted summary judgment to Commission on liability. The panel affirmed. It held that the differing contribution rates were adopted because of the age of the employees which makes the plan facially discriminatory.
