State v Portillo

Portillo was convicted of sexual abuse of his niece. He challenged the trial court qualification of an expert on forensic interviewing. The panel affirmed. It held the trial court did error in qualifying the expert as the South Carolina supreme Court had prohibit such experts and that the witness here made statements that the niece did not appear to be coached and had symptoms consistent with PTSD suggesting belief in her veracity. However, the panel held that any error was harmless beyond a reasonable doubt given some physical evidence consistent with the alleged abuse and the report of the abuse within minutes to Protillo’s wife.
