Brown v Baby Girl Harper

Birth mother signed a consent to adopt. No attorney witness saw her sign and there were no witnesses to any discussions of the terms of the consent. The family court ruled the lack of required witnesses rendered the consent invalid and denied Brown’s petition to adopt Baby Girl Harper. The panel affirmed. It held that South Carolina Code 63-9-340 is mandatory and must be strictly complied with which did not occur here given the lack of an attorney witness or witness to discussion of the terms.
