DOJ OCR Responds to NC


The Department of Justice, Office of Civil Rights Division, sued the state of North Carolina this afternoon (5/9/2016), filing suit in the Middle District of North Carolina.

Submitted by Vanita Gupta, the complaint alleges that H.B.2 “…constitutes a pattern or practice of employment discrimination on the basis of sex in violation of Title VII of the Civil Rights Act of 1964….”   H.B.2 forces “…public agencies to follow a facially discriminatory policy of treating transgender individuals, whose gender identity may not match their birth certificate, differently from similarly situated non-transgender individuals.”

The complaint asks the court to declare the law to be discriminatory, issue an injunction, and provide other relief that is appropriate.
